1. Information Collected
(a) Information That You Provide. Depending on how you use the Website and related functionality, you may voluntarily choose to provide personal information, which includes any information that identifies or can be used to identify, contact, or locate you (“Personal Information”). Examples include your name, address, telephone number, and e-mail address. Whether you choose to share your Personal Information is completely up to you, but please keep in mind that you may not be able to effectively use parts of the Website and related functionality without sharing your Personal Information. Below are some examples of when Personal Information may be collected from you.

(i) Blackbaud Portal Account.
The Website links to a secure password-protected area called the “Blackbaud Portal.” The Blackbaud Portal is operated by Blackbaud, Inc. (“Blackbaud”), an independent third party. The Blackbaud Portal is intended to serve as a resource for students (“Students”), parenting adults (“Parents”), faculty and staff (“Faculty Members”), and coaches (“Coaches”) of the School. Those constituents are provided an account (“Account”) on the Blackbaud Portal upon their entry into the campus community. Your Account will contain certain Personal Information such as your name, address, phone number, email address, and, where applicable, your profile picture, emergency contact information, and birthdate. You may change or update certain Personal Information associated with you Account through the Blackbaud Portal.
If you are provided an Account on the Blackbaud Portal, please do not share your unique log in and password. You are responsible for maintaining the confidentiality of your login and password, and for restricting access to your computer. You also agree to accept responsibility for all activities that occur under your login or password. You agree to immediately notify the School of any unauthorized use of your password or login or any other breach of security.
The Personal Information you provide to Blackbaud will be subject to Blackbaud’s terms of use (https://www.blackbaud.com/company/terms-of-use) and privacy policy (https://www.blackbaud.com/company/privacy-policy/north-america).
Personal Information provided on the Blackbaud Portal is strictly for your personal school-related use and may not be shared with third parties. Use of this information for private, commercial, or political mailings and/or distribution to any outside parties is prohibited. If you misuse information provided on the Blackbaud Portal, we reserve the right, without prior notice to you, to take the appropriate action we deem warranted, which may include denying you access to your Account and the Blackbaud Portal.
(ii) Online Giving.
Online Giving. We will collect certain Personal Information from you through the School’s “Annual Fund” and “Major Gifts” pages. Such Personal Information includes your name, address, phone number, and email address. Online donation transactions on the “Annual Fund” page are processed by Blackbaud. If you wish to make an online donation, your Personal Information relating to such donation will be collected by Blackbaud, and your online donation and the Personal Information collected by Blackbaud will be subject to Blackbaud’s terms of use (https://www.blackbaud.com/company/terms-of-use) and privacy policy (https://www.blackbaud.com/company/privacy-policy/north-america). Certain security for online donations is provided by reCAPTCHA, Inc. (“reCAPTCHA”). In connection with such security, reCAPTCHA may collect your Personal Information, and the security features and the Personal Information collected by reCAPTCHA will be subject to reCAPTCHA’s terms of use (https://policies.google.com/terms?hl=en-GB) and privacy policy (https://policies.google.com/privacy?hl=en-GB). The credit card information that you provide in connection with a donation is not stored by us, but is stored and used by Blackbaud, for it to process your donation. By clicking the “Secure Payment” button on the “Annual Fund” page, you authorize Blackbaud to charge your credit card and to process your donation.
(iii) Online Store.
The Website has an online store (the “Store”) at https://lwhs.org/store. Store transactions are processed by SquadLocker, Inc. (“SquadLocker”), an independent third party. If you wish to make a purchase through the Store, SquadLocker will collect Personal Information such as your name, email address, phone number, shipping address, billing address, and credit card information. Your online purchase and the Personal Information provided to SquadLocker will be subject to SquadLocker’s terms of service (https://www.squadlocker.com/terms-of-service) and privacy policy (https://www.squadlocker.com/privacy-policy). The credit card information that you provide in connection with a purchase is not stored by us, but is stored and used by SquadLocker, for it to process your purchase.
(iv) Alumni Contact Information
Alumni (“Alumni”) may provide the School with their Personal Information such as their name, mailing address, email address and phone number by filling out the online form available at https://lwhs.org/alumni/stay-in-touch.
(v) Peer Connect Mentor Form
To participate in the School’s Peer Connect mentor program, Students may provide the School with their Personal Information such as their name, email address, phone number, birthdate, city, gender and pronouns, and ethnicity by filling out the applicable online form available at https://www.lwhs.org/the-center-for-civic-engagement/peer-connect.
(vi) Correspondence With Us.
You may provide the School with your Personal Information such as your name and email address if you fill out the help form available at https://www.lwhs.org/help. The Website also contains email links to contact us, and you may elect to include Personal Information in communications that you send to us through those links.
(b) Information We Collect As You Access Our Website. In addition to any Personal Information or other information you choose to submit to us, we and our third-party service providers may use a variety of technologies that collect certain non-Personal Information whenever you visit our Website (“Usage Information”). Methods that we use to collect Usage Information include the following:
(i) Cookies.
A cookie is a small text file stored by your browser that allows the Website to “remember” your preferences (such as website bookmarks) on the Website from visit to visit, or to maintain your “logged in” status when visiting protected areas. Usage of a cookie is in no way linked to any Personal Information while on our Website. Web browsers have settings allowing you to reject cookies, or selectively accept cookies, or delete cookies previously accepted. Please be aware that rejecting or deleting cookies from our Website may make certain functions unavailable to you.
(ii) Log Files
Similar to many websites, we use website statistical packages such as Google Analytics to analyze trends in how our Website is accessed and utilized. Information monitored includes internet protocol (IP) addresses, geographic location of visitors (country, city), browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, time spent on pages, and keywords used to find our Website via search engines. This information is anonymous and cannot be directly linked to individual users.
(iii) Online Tracking
Some web browsers have a “Do Not Track” feature. This feature lets you tell websites you visit that you do not want to have your online activity tracked. These features are not yet uniform across browsers. We do not engage in online tracking of our users (i.e., the collection of personal information about a user’s online activities over time and across third party websites or online services), and therefore, the Website is not currently set up to respond to “Do Not Track” signals. We also do not authorize third parties to collect Personal Information about an individual user’s online activities over time and across different websites when a user uses the Website.
2. Use of Collected Information.
Our primary goal in collecting your Personal Information is to respond to and fulfill your requests of us, or to help you use the Website. For example, we will use your Personal Information to process an online donation. We may use technical information to analyze trends, administer and improve the Website, and monitor traffic and usage patterns for information security purposes. In addition, your Personal Information may also be used to send you emergency communications through messages or other alerts, or as otherwise required by law.
3. Disclosure of Information
(a) Service Providers. We may share your Personal Information with companies that perform services for us, such as analyzing user data. They have access to Personal Information as needed to perform their functions but may not disclose your information for other purposes.
(b) Disclosure By Law; Protection of Us and Others. We may disclose information you provide if we, in our sole discretion, believe that disclosure is reasonable to (1) comply with the law, requests or orders from law enforcement, or any legal process (whether or not such disclosure is required by applicable law), (2) protect or defend our or a third party’s rights or property, or (3) protect someone’s health or safety, such as when harm or violence against any person (including you) is threatened. We may also disclose information you provide if we, in our sole discretion, suspect fraud or other illegal activity.
(c) Business Changes. If any or all of our assets are acquired by, or merged with another entity, we will share some or all of your information with this entity and/or your Personal Information may then be owned by that entity.
(d) In the School Directory. The Blackbaud Portal features a directory (the “Directory”) for current members of the School community. The Personal Information of Parents, Faculty Members, Coaches, and Students is automatically disclosed in the Directory unless you “opt-out” by emailing helpdesk@lwhs.org.

4. Modification/Deletion of Information; Opt-Out.
If you need to change any Personal Information that you provide to us, you may update or correct such information by writing us at helpdesk@lwhs.org. You may opt-out of future communications from us by clicking the “unsubscribe” button found at the bottom of email communications, or by contacting us at helpdesk@lwhs.org. Please note that you cannot opt-out of receiving administrative and transaction-related emails from us.

We do not knowingly collect Personal Information from individuals under 13. If you become aware that your child under the age of 13 has provided us with Personal Information, please contact us. If we become aware that an individual under 13 has provided us with Personal Information, we will take steps to remove such information.

If you are visiting our Website from outside the United States, please be aware that your information may be transferred to, stored or processed in the United States, where our servers are located, and our central database is operated. The data protection and other laws of the United States might not be as comprehensive as those in your country. All materials published on the Website, including but not limited to written content, photographs, graphics, images, illustrations, marks, logos, sound or video clips, and animation, are owned by the School or its licensors, and are protected by U.S. and international laws, including laws governing copyrights and trademarks.
The School’s logo, name and all custom graphics on the Website are service marks, trademarks and/or trade dress of the School, and may not be used in connection with any product or service that is not offered by the School without the School’s written permission. 11. No Unlawful or Prohibited Use.
As a condition of your use of the Website, you warrant to the School that you will not use the Website for any purpose that is unlawful or prohibited by this Privacy Policy and Terms of Use. The School maintains this Website to promote the School and provide the latest news and information about the School. Our goal is to keep the Website timely and accurate. If errors are brought to our attention, we will try to correct them. However, the School accepts no responsibility or liability whatsoever with regard to the information on the Website, including on the Blackbaud Portal, and makes no representations about the suitability of the information contained on the Website for any purpose or audience. The Website is provided on an “AS-IS,” “AS AVAILABLE” basis without representations or warranties of any kind, either express or implied.
The School makes no representations or guarantees regarding your ability to transmit and receive information from or through the Website, including through the Blackbaud Portal. The School disclaims any and all liability resulting from or related to any events in which access to this Website, including the Blackbaud Portal, is impaired or unavailable for any reason.
Under no circumstances, including, but not limited to, negligence, will the School be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use this Website. You specifically acknowledge and agree that the School is not liable for any defamatory, offensive or illegal conduct of any user.
